DMCA Copyright Policy
Printer Updates respects the intellectual property of others and complies with the United States Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to notify us of alleged copyright infringement on printerupdate.com, how we respond, and how users can submit a counter-notification.
1. Background
The site publishes descriptions of printer drivers and links to installation files hosted by original manufacturers. We do not upload, mirror, or redistribute copyrighted software. If you nevertheless believe that material on the site infringes a copyright you own or are authorised to represent, you may send us a formal takedown notice under the DMCA.
2. Where to Send a Notice
DMCA notices must be sent to our designated agent at:
Email: support@printerupdate.com
Subject line: “DMCA Takedown Notice”
We give priority to notices received by email. We also accept notices submitted through the Contact page with “DMCA” in the subject line.
If the matter is urgent (for example, redistribution of pre-release software), please mark the subject line “URGENT — DMCA”.
3. What a Valid Notice Must Contain
Under 17 U.S.C. § 512(c)(3), a notice is only effective if it includes all of the following:
3.1 Signature
A physical or electronic signature of the copyright owner, or of a person authorised to act on the owner’s behalf.
3.2 Identification of the Work
A clear description of the copyrighted work claimed to have been infringed. If multiple works are affected, you may provide a representative list rather than listing each one.
3.3 Identification of the Material
The exact URL (or URLs) on printerupdate.com where the allegedly infringing material appears. “The whole site” or “your HP section” is not specific enough — we need direct links.
3.4 Your Contact Details
Full legal name, mailing address, telephone number, and email address at which we can reach you.
3.5 Good-Faith Statement
The following statement, included verbatim or in equivalent terms:
“I have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.”
3.6 Accuracy Statement under Penalty of Perjury
The following statement, included verbatim or in equivalent terms:
“I state under penalty of perjury that the information in this notification is accurate, and that I am the copyright owner or am authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.”
A notice missing any of these elements may be rejected or returned for correction.
4. How We Handle Valid Notices
When we receive a valid notice we will, in most cases within two business days:
- Remove or disable access to the material identified in the notice.
- Notify the user who posted the material (if any) that it has been removed and provide a copy of the DMCA notice, with your contact details.
- Keep a record of the notice and our response.
Where it is clear that no infringement has occurred (for example, if the notice refers to material we do not host or link to), we may decline the notice and reply with an explanation.
5. Counter-Notification
If content you posted has been removed and you believe the removal was a mistake or misidentification, you may send a counter-notification to support@printerupdate.com containing:
- Your physical or electronic signature.
- Identification of the material that was removed, and the URL at which it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your full name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or (if your address is outside the United States) the judicial district in which Printer Updates may be found, and that you will accept service of process from the person who filed the original notice.
Once we receive a complete counter-notification we will forward it to the original complainant. Unless the complainant files a court action within 10–14 business days, we may restore the removed material.
6. False or Fraudulent Claims
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys’ fees. Do not use the DMCA process for competitive, political, or harassment reasons.
7. Repeat Infringers
In accordance with 17 U.S.C. § 512(i), we have adopted a policy of terminating the access of users who are determined to be repeat infringers. We decide what constitutes “repeat” on a case-by-case basis.
8. Not a Substitute for Legal Advice
This page summarises the DMCA process as it applies to our site. It is not legal advice. If you are unsure whether to file a notice or counter-notification, consult a qualified attorney.
